Schilling Hurt??? Sox Luckily Have Receipt

Image:Schilling.jpgYes, the douche you love to hate, Curt Schilling has been rumored to have a shoulder injury that has the right-hander and the club in a dispute over whether he needs surgery and the Red Sox have at least investigated to see if they can void his 2008 contract if he does need surgery. The Globe reported that Schilling recently visited Dr. Craig Morgan, who performed the right-hander's shoulder surgery in 1995. Citing HIPAA rules, Morgan wouldn't comment when contacted by the newspaper. Schilling has also declined to comment, as did Theo Epstein because they hate the Globe

Schilling's salary in 2007 was $13 million, but he spent seven weeks on the disabled list with tendinitis in his right shoulder. He is scheduled to make 8 million this season so if he doesn't play that's an extra 8 million for the Sox to scrape the bottom of the free agent pitcher barrel. While I appreciate all Schill has brought to Red Sox Nation I think he should retire with the ring. His fastball is losing more speed than Palm Springs during a raid, and I rather see what Clay Buchholz or Jon Lester can do in his place.

There are plenty of good, younger pitchers on the market who like a 5th-6th round NFL draft pick would just be happy to get picked at this point. Livan Hernandez anyone????

I just got a text message from a VERY reliable source that says the Red Sox will force Schilling to have surgery (and thus be off the hook for his salary) and he will miss the entire season.

If they are not gonna pay him, how in the hell can the Sox "force" Schilling to have a medical procedure? BTW - While under the knife, perhaps the surgeon can excise that foot out of his mouth as well.

Not to spar with you but I don't get it. If the Sox "demand" Schilling go under the knife and lose this season, surely he would be paid something? A buyout perhaps?

Actually, it's something similar to Workman's Comp. If a player is injured and misses significant time, his salary is paid thru insurance, not by the team. His 8 million counts towards the overall payroll but not against things like the luxury tax.

The Sox' claim is Schilling was injured during this past season (he was, remember?) he did at least one rehab assignment. They are claiming negligence by him not having the surgery either towards the end of last season or shortly thereafter, which would make him ready at some point this year. By him now expected to miss the entire season the Sox are basically filing a fraud claim (injured worse than he said) and will either void his contract or otherwise get out of paying him.

That sounds pretty harsh from a management-employer point of view but then again we are talking about a multi-million dollar contract for services that cannot be rendered.

It would seem that if such action were taken by the Red Sox, then the insurer for the contract would probably have a solid case not to pay Schilling's (whatever was agreed upon from a liability aspect) salary as well.

I wonder if Donald Fehr and the Union will interject if Schilling gets nothing.

How can they claim that? He passed a physical by their training staff. If anything they should call out their own doctors for incompetence.

No surgery for Schill as of now acording to Globe. Freddy Garcia is still on the market. He might be a good pick up, rebounding from an injury and averages over 200 innings a season.
